Allies of DP Gachagua rush to court and get orders preventing their arrest.

There is now cause for relief for the three politicians who support Deputy President Rigathi Gachagua, as the Nairobi High Court on Friday issued temporary orders preventing their arrest, detention, and prosecution.

The three are Pius Munene, a former member of parliament from Nyeri Town, Ngunjiri Wambugu, and George Theuri, a former lawmaker from Embakasi West.

Judge Lawrence Mugambi of the High Court issued the orders against the Office of the Director of Public Prosecutions (ODPP) and the Directorate of Criminal Investigations (DCI). The petitioners were also instructed to file and serve the respondents in the case within seven days.

On October 15, 2024, Justice Mugambi scheduled a mention of the case.

The three politicians filed a lawsuit in this case, arguing that on September 26 of this year, they were informed of a plan among the respondents to detain and prosecute them on what they considered to be false accusations.

They consequently contended that their planned detention and prosecution amounted to a misuse of the legal system and a mockery of it.

This occurs subsequent to the approval of charges by DPP Renson Ingonga against five individuals for their purported involvement in organizing, coordinating, and providing funding for the anti-government protests led by youth in June.

The five, who are associated with DP Gachagua, have been approved to face the charges, according to a letter from the DPP dated September 26, 2024, to DCI Amin Mohamed.

“After carefully reviewing the material, the DPP has decided that there is enough evidence to charge the suspects with conspiracy to commit a felony in violation of Penal Code section 393. A portion of the letter stated, “In addition, a separate inquiry file should be opened for money laundering and financial crimes related offenses.
