The Supreme Court refused to stop impeachment for Gachagua

For the second time, the Supreme Court refused to issue an order to stop the intimidation of Vice President Rigati Gachagua.
The matter came up on Monday before Justice Bahati Mwamuye, who ordered Cleopas Malale’s case file to be sent to Chief Justice Chacha Mwita for further guidance.

At that time, the National Assembly, in a petition seeking to consolidate all the opposition challenges, said that the cases with similar issues should be brought together for trial to promote the efficient and speedy processing of petitions..

The petition states: “Thirteen (13) petitions are currently pending in the High Court in Nairobi and other centers across the country, challenging the judgment of H.E. Rigathi Gachagua as Vice President of Kenya.


On September 30, the court refused to issue an order preventing parliament from hearing the impeachment petition against Vice President Rigathi Gachagua.

The motion tabled by former UDA Secretary General Cleophas Malala sought to prevent the National Assembly and the Senate from tabling, debating, considering or acting on any motion seeking to remove DP Gachagua.

Malala argued that both parliaments did not meet the threshold of two-thirds of the gender law, and therefore violated constitutional requirements..
