Case filed to stop Cj Koome from swearing new Dp

In the event that the Senate upholds the impeachment of current office holder Rigathi Gachagua, an attorney has filed a case at the Eldoret High Court seeking to block Chief Justice Martha Koome or anyone acting on her orders from swearing in any nominated Deputy President.

The impeachment of DP Gachagua was challenged by Morara Omoke in a certified urgent petition, citing a number of irregularities in the gathering of MP signatures, insufficient public participation, violations of constitutional provisions, and the exclusion of the second-in-command from official duties, among other reasons.

“The circumstances surrounding this impeachment motion presented an immediate threat to national unity and have the potential to recur historically with the regrettable post-election violence that occurred in the Republic in 2007.

” The impeachment motion was passed by 281 National Assembly members.” Omoke claims that the impeachment motion of DP Gachagua was not properly considered or based on significant national public involvement.

“The removal of a Deputy President from office must be people-driven and involve consultation of people throughout the nation,” he stated.

“Prior to the gathering of signatures, Hon. Mutuse Eckomas Mwengi, Member of Parliament, Kibwezi West Constituency, did not conduct prior public participation.”

Omoke further contended that there was bribery involved in the signature gathering process for the DP’s impeachment, which was defective and did not involve public participation.

If lawmakers did not support the motion, he claimed they would be threatened with the cancellation of constituency projects.

Furthermore, he claimed that some signatures were fake, referencing Vincent Musyoka, the Mwala MP, who expressed surprise at seeing his name on the list even though he had not signed.

“The petitioner claims that the signatures of Hon. Bernard M. Shinali and Hon. Emmanuel Wangwe were faked in the list of collected signatures. According to court documents, “the handwriting is distinctly identical, indicating that the author of both their names and signatures is one and the same person.”

Likewise, the same author is behind the signatures of Hon. Lilian Siyoi and Hon. Paul K. Chebor. Additionally, the petitioner mentions that Hon. Wario Guyo signed both at Nos. 121 and 177, although his signatures are not identical.

This demonstrates the degree of forgery involved in gathering signatures in favor of the impeachment motion.” While pointing out that Gachagua’s defense of the rights of people in Mount Kenya is one of the reasons for her impeachment.
