Supreme Court referred Gachagua’s impeachment petition to CJ Koome

Supreme Court Justice Lawrence Mugambi delivered the ruling on Friday, saying the case calls for CJ Kome’s attention because it was a public issue. “Courts are there to serve the people in matters they care deeply about and this is one of those uncommon occasions when the court will serve the people in any way it can.

“In my opinion, we are faced by strong objections from the respondents, but i am of the opinion that this petition involves serious legal problems covered by Article 163 b and d(2), and therefore the best thing to do is to submit the case to Chief Justice and that is constitutional.

He also pointed out the need for a full review of the process of public participation on matters impeachment of the Vice President Gachagua.

Lawyer Muite said: “It’s not about the numbers in the National Assembly… there has to be evidence of a serious breach of the constitution, that’s important.”


In addition, Muite stated that the concept of the constitution is paramount and the court must consider the sovereignty of the people who chose in favor of the president and the vice president.
