CJ Martha Koome dismisses questions on Gachagua’s impeachment case

In an apparent shock over her prolonged silence, Koome made a public appearance on Tuesday evening when she visited Makadara courts..

The CJ was interacting with the staff and at one point in the interaction a member of the public challenged her to talk about Gachagua’s trial.

In response, CJ Koome dismissed the case, saying the matter was outside her jurisdiction for now, saying: “It’s a matter for the Supreme Court. It hasn’t come to me yet .”

Koome’s appearance went public after it was revealed on Tuesday that she had left the country sometime last week, and Deputy Chief Executive Philomena Mwilu challenged the panel of three judges to hear the case.

Earlier today, Gachagua’s legal team took a long time to question whether Mwilu had the right to make the appointment, saying only CJ Koome had the right.

The Senior Counsel, Paul Muite, stated that the circumstances surrounding reasons why the file was brought to this bench on a Saturday were not explicitly specified by the Chief Justice regarding the composition of rehearsed proceedings.

The DCJ’s appointment of all three judges to hear an application by the State seeking to set aside orders that blocked Kithure Kindiki’a appointment was accompanied by malice, as the DP had perceived.

The court proceedings on Tuesday were complicated by Gachagua’s team’ reluctance to trust the three-judge bench, leading to adjournment and parties being allowed to challenge the empanelment.

The day also saw President William Ruto questioning the High Court’s ability to hear petitions challenging the impeachment..

The president, through his legal team, asked the Supreme Court to dismiss Gachagua’s impeachment cases, which he said should be heard by the Supreme Court.

Gachagua will learn his fate on Wednesday 23 October at 15:00, a panel of three judges will decide if they should dismiss the three cases assigned to them by Deputy Director Philomena Mwilu ..
