MCA filed a motion to remove Nyandarua Governor Badilisha

A Nyandarua County Assembly member has taken legal action by moving to court to request the removal of Governor Moses Ndirangu Badilisha due to an alleged breach of the constitution.
In his petition, MCA Samuel Wainaina contends that Governor Badilisha has consistently violated the law and blatantly disregarded county regulations.

He expresses that the governor’s behavior is described as “unethical, deplorable, and  reprehensible,” and states that it is “not in line with the esteemed position and dignified reputation of the Office of the Governor of Nyandarua County. “

Wainaina mentions that around September 5, 2024, Ndirangu, with the County Executive Member for Finance, Economic Planning, and ICT, authorized and supervised the assignment of the  Governor’s Service Delivery Unit (GSDU Officers) to manage the seven revenue stations in the county, in violation of the law.

The petition states that these actions seem to be aimed at deceiving and misusing revenues at their origin, ultimately leading to a detrimental impact on the service provision to the residents of Nyandarua County.

He further alleges that the governor has unlawfully recruited county staff who are still receiving salaries from the county funds.

MCA Wainaina has also stated that the Governor violated Section 47A of the Anti-Corruption and Economic Crimes Act by participating in corrupt practices, as he allegedly  solicited funds from suppliers to the county.

He mentions that the governor has not succeeded in guaranteeing timely payment for the services rendered, resulting in a buildup of unpaid bills.

The Governor implemented a pyrethrum program in the budget, purchasing seedlings at significant costs, which unfortunately did not thrive as anticipated. He argued that the pyrethrum program was designed solely to extract money from public coffers for self-serving and personal gain using public funds.

Wainaina further argues that the governor violated the Public Procurement and Asset Disposal Act by awarding his own company a construction project for the county that he claims  was below standard.

He mentioned that the company did not complete the works satisfactorily because the county public works did not approve some of the works for payment due to not meeting  the requirements of the Kenya building code and standards.

He mentions that Governor Badilisha has unlawfully granted catering contracts to a hotel associated with him and has overlooked the scrutiny of procurement  transactions that pass through the county’s financial department.

He is urging the County Assembly to support his motion to remove  the governor, as he believes that the governor poses a significant threat to the County’s economic stability and progress.
