Court refuses to stop Senate from hearing impeachment requests.
It is expected that DP Gachagua stands for himself against the allegations that are being made as grounds for annulment when the bill comes to the floor of the Senate on Wednesday and Thursday, according to plan drawn up by the secretary.
Milimani Law Court judge Chacha Mwita said in his ruling that the motion should be allowed to continue until it ends.
Judge Mwita, states that the CJ will now consider hearing the three judges appointed to hear the other impeachment petitions and also hearing the motion to stop the Senate’s action. Dismissal Actions
The judge’s ruling: “In light of the parties’ motion and arguments on constitutional and historical grounds, the request to grant the trustee’s judgment is denied.”
In view of the issues raised in this petition, which appears to be related to petition E522/2024, which was granted in order to determine the number of judges who are not fit for trial, I suggest that consider this petition Legal issues and public interest based on section 4 of article 165 of the Constitution. This case will be referred to the Honorable Chief Justice for consideration and determination of the lack of justice to hear this petition.
Judge Mwita also said: “Given the closeness of the issues in the petition to those in the E522 petition, the Honorable Chief Justice may consider whether this petition should be heard by the one division appointed to hear petition E522. Allowed or not?.
CJ Martha Koome appointed a lawyer led by Justice Eric Ogola and Justice Anthony Mrima and Dr Frida Mugambi to hear the five petitions seeking to stop the impeachment of DP Gachagua.
