Following a heated debate and legal exchange between the team of vice president Rigathi Gachagua and the court over the appointment of the three judges hearing the case..
Gachagua’s group told the court that the investigation team in the case was created illegally, so they want the process of creation to be clear.
Three judges are judges. Eric Ogola, Anthony Mrima and Frida Mugambi ruled that the question and issues raised by Gachagua’s team were of serious interest and therefore the court should not continue further complicating things.
Chief Justice Ogola ordered Gachagua’s lawyers to file a new motion for their claim after which the trial will resume at 2pm for the sentencing.
“This court is handling the proceedings, this is a very serious case, for the vice president of this country, I will not everybody speak, we must have order.’ advises Ogola.
“This is the way to go, we have to file a petition challenging the jurisdiction of this court within one hour and respond within one hour. We are coming to hear this matter. Earlier, Gachagua’s legal team said Associate Justice Philomena Mwilu did not have the authority to establish a division after the reports issued by the three judges presiding over the case.
Mwilu’s decision after justice Martha Koome left the country when the bail was set up. Gachagua’s lawyer Ndegwa Njiru, who announced the decision to appoint Mwilu was discriminatory..
He added that this crime shows the seriousness of the government in this matter and therefore a decision should be taken against him.
”Why is the court disregarding us? Could it be because our cases are not priority? DCJ powers up the bar, and speedily summoned us to get in front of you. Isn’t that an order that the government wants to vacate?” Ndegwa said.
The judge then adjourned the hearing..
