JSC dismisses LSK’s allegations of transparency in Judiciary.

The Judicial Service Commission has firmly denied the claims propagated by the Law Society of Kenya of being excluded from key processes involving judicial oversight.
In a statement issued Tuesday morning, the JSC declared that the LSK had been involved in important legislative reforms, such as the Draft JSC Regulations 2024. The JSC further accused the Society of issuing misleading statements aimed at destroying confidence in the judiciary.

The JSC gave an elaborate explanation of its efforts to have LSK participate in the draft process.

Members were asked for their input on the regulations in July 2023, followed by a joint webinar in December 2023. The LSK members at the webinar engaged the JSC in the deliberation of the proposals.

 


According to the report from JSC, many of the recommendations from LSK, including those relating to anonymous complaints, have been incorporated into the draft.

 


This signals that the regulations are now destined for public comment,  proof of the JSC’s commitment to openness and inclusivity.

The JSC has clarified that the statement regarding exclusion of the LSK is not accurate and might cause misunderstanding. On the contrary, the LSK has been actively engaged in these processes and has made extensive contributions to the formulation of the draft regulations.

The JSC also reacted to the interests of the LSK to take up more involvement in handling complaints and petitions against judicial officers, observing that such demands, if yielded to, would compromise the independence of the Commission.

The JSC reiterated its commitment to constructive dialogue with all parties, including the LSK, but it would remain firm on its stand.

It noted that it was necessary, at all times, to ensure that such collaborations do not breach the constitutional safeguards for Commission autonomy.

The JSC said it was “constitutionally committed to discharging its duty” and assured the public that each petition and complaint would be handled with the highest degree of integrity, impartiality, and respect for due process.
